Welcome to Miwa Banquets. These Terms and Conditions (“Terms”) govern your use of our services and facilities. By booking our venue or services, you agree to be bound by these Terms. Please read them carefully.

1. Definitions

In these Terms:

  • “Miwa Banquets,” “we,” “us,” or “our” refers to Miwa Banquets, located at Kaspate Wasti Rd, near Kalpataru Splendour, Shankar Kalat Nagar, Wakad, Pimpri-Chinchwad, Pune, Maharashtra 411057
  • “Client,” “you,” or “your” refers to the individual or entity booking our services
  • “Event” refers to any function, celebration, or gathering hosted at our venue
  • “Booking” refers to the reservation of our venue and/or services
  • “Contract” refers to the agreement formed between Miwa Banquets and the Client

2. Services Offered

Miwa Banquets provides venue rental and event hosting services for various occasions, including but not limited to:

  • Weddings and wedding receptions
  • Corporate events and conferences
  • Birthday parties and anniversaries
  • Social gatherings and celebrations
  • Other private or public events

Services may include venue rental, catering, decoration, audio-visual equipment, and other amenities as agreed upon during booking.

3. Booking and Reservations

3.1 Booking Process

To book our venue, clients must:

  • Contact us via phone (090673 35755), email (miwabanquet@gmail.com), or in-person visit
  • Provide complete and accurate information about the event
  • Review and agree to these Terms and Conditions
  • Pay the required deposit to confirm the booking

3.2 Booking Confirmation

A booking is confirmed only when:

  • The required deposit has been received
  • We have issued a written confirmation (via email or written document)
  • Both parties have signed the booking agreement (if applicable)

3.3 Availability

Venue availability is subject to prior bookings. We recommend booking well in advance, especially for peak seasons and weekends. Availability is not guaranteed until a confirmed booking is made.

4. Payment Terms

4.1 Deposit

A non-refundable deposit of 25% of the total estimated cost is required at the time of booking to secure your reservation. This deposit will be applied toward your final balance.

4.2 Payment Schedule

Unless otherwise agreed in writing, the payment schedule is as follows:

  • At booking: 25% deposit (non-refundable)
  • 30 days before event: 50% of total cost
  • 7 days before event: Remaining 25% balance

4.3 Accepted Payment Methods

We accept the following payment methods:

  • Credit cards
  • Debit cards
  • Google Pay
  • Bank transfers (upon request)
  • Cash (for in-person payments)

4.4 Late Payment

Failure to make payments according to the agreed schedule may result in:

  • Cancellation of your booking
  • Forfeiture of all deposits paid
  • Additional late payment charges

4.5 Additional Charges

Additional costs may apply for:

  • Extra guests beyond the agreed number
  • Extended event hours
  • Additional services requested during the event
  • Damages to property or equipment
  • Special cleaning requirements

Such charges will be billed separately and must be paid within 7 days of invoice.

5. Cancellation and Refund Policy

Important: All deposits are non-refundable to compensate for administrative costs and lost booking opportunities.

5.1 Cancellation by Client

If you need to cancel your booking, the following terms apply:

  • More than 90 days before event: Deposit forfeited; any additional payments refunded
  • 60-90 days before event: 50% of total booking cost forfeited
  • 30-59 days before event: 75% of total booking cost forfeited
  • Less than 30 days before event: 100% of total booking cost forfeited (no refund)

All cancellations must be made in writing via email to miwabanquet@gmail.com.

5.2 Cancellation by Miwa Banquets

We reserve the right to cancel bookings in extraordinary circumstances, including but not limited to:

  • Acts of God (natural disasters, extreme weather conditions)
  • Government orders or restrictions
  • Emergencies or unforeseen circumstances making the venue unusable
  • Breach of these Terms by the Client

In such cases, we will provide full refund of all payments made. However, we are not liable for any consequential losses, expenses, or damages incurred by the Client.

5.3 Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including natural disasters, pandemics, government actions, civil unrest, or other force majeure events.

6. Modifications and Changes

6.1 Changes to Booking

Requests to modify booking details (date, time, guest count, services) must be made in writing and are subject to:

  • Venue availability
  • Written approval from Miwa Banquets
  • Potential adjustment in pricing
  • Additional charges if applicable

6.2 Date Changes

Date changes are permitted subject to availability. If you request a date change:

  • More than 60 days before event: One free date change allowed
  • 30-60 days before event: Date change fee of ₹10,000 applies
  • Less than 30 days before event: Treated as cancellation (see Section 5.1)

6.3 Guest Count Changes

Final guest count must be confirmed at least 7 days before the event. Increases in guest count are subject to:

  • Venue capacity limits
  • Proportional increase in costs
  • Availability of additional resources

Reductions in guest count less than 7 days before the event will not result in reduced charges.

7. Client Responsibilities

As the Client, you are responsible for:

7.1 Accurate Information

  • Providing accurate event details and guest information
  • Informing us of any special requirements or dietary restrictions
  • Updating us promptly of any changes

7.2 Guest Conduct

  • The behavior and conduct of all guests and attendees
  • Ensuring guests comply with venue rules and regulations
  • Any damages or losses caused by guests

7.3 Legal Compliance

  • Obtaining any necessary permits or licenses for your event
  • Compliance with all applicable laws and regulations
  • Ensuring the event does not violate any legal provisions

7.4 Third-Party Vendors

If you wish to bring external vendors (decorators, photographers, entertainers):

  • Prior written approval from Miwa Banquets is required
  • Vendors must provide proof of insurance and relevant licenses
  • You are responsible for coordinating and supervising these vendors
  • Any damages caused by external vendors are your responsibility

8. Venue Rules and Regulations

8.1 Capacity Limits

The venue has a maximum capacity that must not be exceeded for safety and comfort reasons. Overcrowding may result in immediate event termination without refund.

8.2 Prohibited Items and Activities

The following are strictly prohibited on our premises:

  • Illegal drugs or substances
  • Weapons or dangerous items
  • Smoking in non-designated areas
  • Open flames or fireworks without prior approval
  • Activities that may damage property or disturb neighbors
  • Discrimination, harassment, or offensive behavior

8.3 Alcohol Policy

If alcohol is to be served:

  • Service must comply with all applicable Indian laws
  • Alcohol must not be served to minors (persons under 18 years of age)
  • We reserve the right to refuse service or terminate the event if guests become disorderly
  • Client is responsible for arranging necessary permits/licenses as per local regulations

8.4 Music and Noise

  • Music and entertainment must end by the agreed time
  • Volume levels must comply with local noise regulations
  • We may reduce volume or terminate entertainment if complaints are received

8.5 Decorations

  • Decorations must not damage walls, ceilings, or fixtures
  • No nails, screws, or permanent adhesives without prior approval
  • All decorations must be removed by the end of the event
  • Open flames (candles, diyas) require prior approval and safety measures

8.6 Event Timing

  • Events must start and end at agreed times
  • Access for setup and breakdown is limited to agreed hours
  • Extensions beyond agreed time will incur additional hourly charges
  • Venue must be vacated by the agreed end time

9. Liability and Insurance

9.1 Our Liability

Miwa Banquets shall not be liable for:

  • Personal injury or property damage caused by guests or third parties
  • Loss or damage to personal belongings brought to the venue
  • Delays or failures in service delivery due to circumstances beyond our control
  • Actions or omissions of third-party vendors you have contracted
  • Any consequential, indirect, or special damages

To the extent permitted by law, our total liability shall not exceed the total amount paid for the booking.

9.2 Your Liability

You are liable for:

  • Any damage to our property, equipment, or facilities caused by you, your guests, or your vendors
  • Injuries or losses arising from your event activities
  • Violations of applicable laws or these Terms
  • Loss or damage caused by negligence or misconduct

9.3 Indemnification

You agree to indemnify and hold harmless Miwa Banquets, its owners, employees, and agents from any claims, damages, losses, or expenses arising from your event, including legal fees, except where caused by our negligence.

9.4 Insurance

We recommend that clients obtain event insurance to cover potential liabilities, cancellations, or unforeseen circumstances. We maintain our own liability insurance, but this does not cover client’s personal liability.

10. Intellectual Property

10.1 Photography and Videography

We may photograph or video record events for promotional purposes. By booking our venue, you grant us permission to use such media on our website, social media, and marketing materials.

If you do not wish your event to be photographed or used for promotional purposes, please notify us in writing at the time of booking.

10.2 Your Content

You retain ownership of any content, materials, or intellectual property you provide. However, you grant us a license to use such materials as necessary to provide our services.

11. Data Protection and Privacy

We collect and process personal information in accordance with our Privacy Policy, which can be found on our website. By using our services, you consent to such collection and processing.

We are committed to protecting your privacy and maintaining the confidentiality of your information in accordance with applicable Indian data protection laws.

12. Termination Rights

We reserve the right to terminate an event and require all persons to leave the premises immediately if:

  • These Terms are breached
  • Illegal activities are taking place
  • Safety concerns arise
  • Guest conduct is unacceptable
  • The venue or property is at risk of damage

In such cases, no refund will be provided, and you remain liable for all agreed payments and any damages.

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra.

13.2 Negotiation and Mediation

In the event of a dispute, both parties agree to first attempt to resolve the matter through good faith negotiation. If negotiation fails, the parties may pursue mediation before initiating legal proceedings.

13.3 Legal Action

Any legal action must be commenced within one year of the event that gave rise to the claim.

14. Miscellaneous Provisions

14.1 Entire Agreement

These Terms, together with any booking confirmation and additional agreements, constitute the entire agreement between the parties and supersede all prior negotiations, representations, or agreements.

14.2 Amendments

We reserve the right to update these Terms at any time. Changes will be effective upon posting to our website. Bookings already confirmed will be governed by the Terms in effect at the time of booking.

14.3 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14.4 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

14.5 Assignment

You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign our rights and obligations at our discretion.

14.6 Notices

All notices under these Terms must be in writing and sent to the contact addresses provided. Notices are deemed received:

  • When delivered in person
  • On the date sent by email (if confirmed received)
  • Three business days after being sent by mail
